By using our website, booking a service, referring a client, or working with us, you agree to these Terms.
1. Services We Provide
Next Phase Living delivers a range of services including:
• Personal training
• Health, fitness and lifestyle coaching
• NDIS support and community access
• Mentoring and wellbeing support
• Goal setting and planning (3Phase method)
• Client referral support
• Online resources and general guidance
All services are tailored to the individual’s goals, capacity, and needs.
2. General Fitness & Health Disclaimer
• The information on this website is for general guidance only.
• Fitness or lifestyle recommendations do not replace medical advice.
• Always consult your GP or healthcare professional before starting a new exercise program, especially if you have a medical condition or injury.
• You agree to participate in training and movement sessions at your own risk, unless otherwise required under your NDIS or support plan.
We will always work within safe, appropriate limits based on your ability and presentation on the day.
3. Duty of Care & Safety
As a support worker and fitness professional, we operate with a high duty of care.
We may, at our discretion:
• Modify or stop a session if we feel your safety may be at risk
• Request medical clearance if necessary
• Decline or discontinue service if behaviour, risk, or circumstances make the environment unsafe for either party
Your safety, wellbeing, and dignity is always the priority.
4. Client Responsibilities
To ensure smooth and safe service delivery, you agree to:
• Provide accurate and up-to-date information
• Inform us of any medical conditions, medications, or changes in health
• Arrive on time for sessions
• Follow reasonable safety instructions
• Treat staff with respect and courtesy
• Notify us of cancellations within the agreed timeframe
If providing false or misleading information leads to risk or injury, Next Phase Living is not liable.
5. NDIS Participant Responsibilities
If you are an NDIS participant or representative:
• You confirm you have the authority to engage our services
• You agree to provide accurate plan details
• You agree to follow NDIS safety and conduct expectations
• You agree to pay for services using your plan or submit invoices to your Plan Manager
We operate in alignment with NDIS Code of Conduct requirements.
6. Cancellations, Rescheduling & Fees
Unless otherwise outlined in your individual service agreement:
• Less than 24 hours’ notice may be charged at the full session rate
• “No-shows” may be charged at the full session rate
• Sessions may be rescheduled depending on availability
If we need to cancel due to illness, emergencies, or unforeseen circumstances, you will not be charged and the session will be rescheduled.
7. Payments & Invoicing
Depending on service type:
• Direct debit
• Plan Manager invoicing
• Self-managed NDIS payments
• Bank transfer or approved online payment methods
Invoices must be paid within the timeframe listed on the invoice.
We reserve the right to pause or discontinue service if payments fall overdue.
8. Referral Submissions
By submitting a referral through our website:
• You confirm the information is accurate
• You have consent from the participant or guardian to share their details
• You understand this is an enquiry process and does not guarantee immediate availability
All information is handled according to our Privacy Policy.
9. Limitation of Liability
To the fullest extent permitted by law:
• Next Phase Living is not responsible for injuries, accidents, or damages resulting from misuse of information, failure to follow instructions, or undisclosed medical conditions
• We are not liable for indirect, incidental, or consequential loss
• We do not guarantee specific results, weight loss, muscle gain, or performance outcomes
We will always act professionally and responsibly, but some factors are beyond our control.
10. Use of Website
By using our website, you agree not to:
• Misuse forms or submit false information
• Attempt to disrupt, hack, or damage the site
• Reproduce or distribute content without permission
